Terms of service
1. Operator and Scope
This website (svetlanalampe.sk, shop.benocode.sk) and the online store "Svetlana Lampe" (the "Store") are operated by BenoCode s.r.o., registered office Rázusova 6, 949 01 Nitra, Slovak Republic, IČO 55 920 918, VAT SK2122131110, registered with the Commercial Register of the District Court Nitra, Section: Sro, Insert No. 62043/N (the "Trader", "we", "us"). By placing an order, you ("Customer", "you") confirm that you have read, understood and accepted these Terms of Service.
2. Products
The Trader sells custom 3D-printed table lamps and related accessories (the "Goods"). All Goods are manufactured to order. Product images are 3D renders or photographs; actual colours, surface finish and texture may vary slightly due to the nature of 3D-printing and screen calibration. All lamps comply with the EU Low Voltage Directive 2014/35/EU and bear the CE mark. An EU Declaration of Conformity is available on request and on our website.
3. Offer and Conclusion of Contract
The presentation of Goods on the Store does not constitute a binding offer. By submitting your order through the checkout, you make a binding offer to purchase the selected Goods. The contract is concluded when we send you a confirmation of acceptance by email (typically the order confirmation). Until that point we may decline the order without giving reasons.
4. Pricing and Payment
All prices are stated in EUR and include VAT applicable in the country of delivery. Shipping is free for the destinations listed in our Shipping Policy. Accepted payment methods are displayed at checkout and include major credit/debit cards and other methods supported by the Shopify Payments processor. Payment is captured immediately upon order placement.
5. Delivery
Delivery times, methods, and destinations are detailed in our Shipping Policy, which forms part of these Terms. Risk passes to you upon delivery; title passes upon receipt of full payment.
6. Right of Withdrawal (Consumers)
If you are a consumer in the European Union, you have a 14-day right of withdrawal in accordance with Directive 2011/83/EU. The full conditions, the model withdrawal form, and exceptions are set out in our Refund Policy, which forms part of these Terms.
7. Statutory Conformity Guarantee
Goods delivered to consumers are covered by the statutory conformity guarantee for two (2) years from delivery in accordance with Directive (EU) 2019/771 and applicable national consumer law. See our Refund Policy for details on how to make a claim.
8. Complaints
Complaints regarding the quality, completeness, or condition of the Goods should be addressed in writing to contact@svetlanalampe.sk. Please include your order number and (where possible) photographs. We will acknowledge your complaint within five (5) business days and resolve it within thirty (30) days, unless a longer period is agreed with you.
9. Out-of-Court Dispute Resolution (ADR / ODR)
We commit to participating in alternative dispute resolution (ADR) proceedings before the Slovak Trade Inspection (Slovenská obchodná inšpekcia, Inšpektorát SOI pre Nitriansky kraj, Staničná 9, P. O. BOX 49A, 950 50 Nitra 1, www.soi.sk) as the competent ADR body for consumer disputes arising from our online sales. If you are a consumer in the European Union and we have been unable to resolve your complaint, you may submit a request for ADR to SOI directly. The European Commission's Online Dispute Resolution (ODR) platform is also available at https://ec.europa.eu/consumers/odr/. The list of all approved ADR entities is maintained by the Slovak Ministry of Economy.
10. Liability
To the extent permitted by mandatory consumer law, our liability for damage caused by simple negligence is limited to the foreseeable damage typical for the contract. Our liability for personal injury, intent, gross negligence, fraudulent concealment of defects, and under the Product Liability Directive 85/374/EEC is unlimited. Nothing in these Terms restricts your statutory rights as a consumer.
11. Intellectual Property
All content on the Store — including text, images, 3D renders, logos, and graphics — is owned by or licensed to BenoCode s.r.o. and is protected by copyright and other intellectual-property laws. You may view and download content for personal, non-commercial use; any other use requires our prior written consent.
12. Privacy and Data Protection
Information about how we process your personal data is set out in our Privacy Policy, which forms part of these Terms. We process personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Slovak law.
13. Newsletter and Marketing Communications
You may opt-in to receive our newsletter at checkout or via our website. You can unsubscribe at any time using the link in any newsletter email or by writing to contact@svetlanalampe.sk.
14. Force Majeure
Neither party is liable for failure to perform that is caused by events beyond reasonable control, including (without limitation) strikes, labour disputes, supplier failures, transportation interruptions, governmental actions, fires, floods, epidemics, or armed conflict. Affected obligations are suspended for the duration of the event.
15. Governing Law and Jurisdiction
These Terms are governed by the law of the Slovak Republic, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules. The exclusive place of jurisdiction is the courts of the Slovak Republic. Mandatory consumer-protection rules of the country of the consumer's habitual residence remain unaffected.
16. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect. The invalid provision shall be replaced by a valid provision that comes closest in commercial intent.
17. Changes to These Terms
We may update these Terms from time to time. The version in force at the time of contract conclusion governs that contract. The current version is always published on this page.
